Refund Policy

1. Overview

Refund Policy Agreement:

This Refund Policy governs the refund and cancellation terms for services provided by PS Dev Studio("Company," "we," "us," or "our"). By engaging our services, you ("Client," "you," or "your") agree to the terms outlined in this policy.

2. Project Cancellation Terms

2.1 Client-Initiated Cancellation: You may cancel your project at any time by providing written notice via email to hello@psdev.studio. The refund amount will be determined based on the percentage of work completed at the time of cancellation notice.

Important Refund Structure:

  • Less than 50% completion: You will be charged only for work completed to date, plus any non-refundable expenses incurred on your behalf.
  • 50% or more completion: You will be charged 100% of the total project fee, regardless of the final completion status.

2.2 Work Completion Assessment: Project completion percentage is determined based on:

  • Milestones achieved as outlined in the Statement of Work
  • Time invested in project development and design
  • Resources allocated and third-party services procured
  • Deliverables completed and approved by the client

CLIENT NEGLIGENCE - NO REFUND POLICY:

If we request materials, information, feedback, approvals, or access from you, and you fail to provide these items within ten (10) business days, this constitutes negligence on your part.You will NOT be entitled to refunds for work that was not completed while we were waiting for your response, regardless of overall project completion percentage.

3. Non-Refundable Items

Items Never Eligible for Refund:

The following items are non-refundable regardless of project status:

  • Third-party software licenses and subscriptions purchased for your project
  • Domain registration and hosting setup fees
  • Stock photography, fonts, or other licensed assets
  • Payment processing fees
  • Initial consultation and discovery phase work
  • Custom integrations with external services

4. Company-Initiated Termination

Company Termination Rights & Consequences:

4.1 Breach of Contract: We reserve the right to terminate services immediately if you:

  • Fail to make payments according to the agreed schedule
  • Provide false or misleading information
  • Request work that violates applicable laws or our ethical standards
  • Engage in abusive or threatening behavior toward our team

4.2 Refund in Company Termination: If we terminate the project due to your breach, you remain liable for all work completed and expenses incurred. NO REFUND will be provided.

4.3 Company Fault: If we terminate due to our inability to complete the project (excluding force majeure events), you will receive a full refund of payments made, minus any non-refundable expenses already incurred.

5. Refund Processing

Refund Processing Details:

5.1 Timeline: Approved refunds will be processed within 14 business days of cancellation notice and final project assessment.

5.2 Method: Refunds will be issued to the original payment method used. If the original payment method is unavailable, alternative arrangements will be made.

5.3 Documentation: All refund calculations will be provided in writing, including a detailed breakdown of completed work and associated costs.

6. Work Product Delivery

Work Delivery & Payment Requirements:

6.1 Completed Work: Upon project cancellation, you will receive all completed work products for which full payment has been made.

6.2 Partial Work: Work in progress or incomplete deliverables will be provided"as-is" without warranty, and may require additional development to be functional.

6.3 Source Files: Access to source files, development environments, and proprietary methodologies requires full payment of the project fee.

7. Dispute Resolution

Legal Framework & Dispute Process:

7.1 Good Faith Negotiation: Both parties agree to attempt resolution of any refund disputes through good faith negotiation before pursuing formal legal action.

7.2 Mediation: If negotiation fails, disputes may be submitted to binding mediation through a mutually agreed upon mediator in Riverside County, California.

7.3 Governing Law: This policy is governed by the laws of the State of California.

8. Force Majeure

Unforeseeable Circumstances:

Neither party shall be liable for delays or failures in performance resulting from acts beyond reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, strikes, or government regulations. In such cases, project timelines may be extended, but refund terms remain unchanged.

9. Policy Updates

Policy Change Notice:

This Refund Policy may be updated from time to time. Changes will apply only to projects initiated after the effective date of the updated policy. Current clients will remain subject to the policy in effect at the time of their project commencement.
